General Terms and Conditions (T&C)
§1 Scope and Agreement
- These General Terms and Conditions apply to all contracts, treatments, and services between Laser Angel (Owner: Angila Nuristani, An der Alster 83, 20099 Hamburg) and its customers.
- By booking an appointment or utilizing a service, the customer expressly accepts these GTC.
- Deviating conditions of the customer will not be recognized unless Laser Angel expressly agrees to their validity in writing.
§2 Conclusion of Contract and Appointment Booking
- A treatment contract is concluded through the booking of an appointment (by telephone, in writing, in person, or via online booking systems) and the associated deposit.
- Agreed and/or reserved appointments are binding for both contracting parties – even without a paid deposit.
- A deposit is required for every new appointment booking. This will be deducted from the total cost of the treatment afterward.
- The customer has the right to postpone their appointment once free of charge without the paid deposit expiring.
- In the event of a cancellation after a booking has been made, the deposit in the amount of 50.00 EUR will be retained as a booking fee.
§3 Prices and Payment
- The prices displayed at the time of booking apply. All prices are final prices in accordance with applicable tax regulations.
- Payment of the remaining treatment costs takes place on-site immediately after the treatment. Accepted methods of payment will be announced in the studio.
- The paid deposit will be credited toward the total amount of the treatment.
§4 Cancellation, Rescheduling, and Loss Compensation
4.1 Timely Cancellation
- Appointments can be canceled or postponed without additional costs at the latest 48 hours before the agreed treatment appointment.
- In this case, a deposit already paid remains valid (minus the booking fee according to §2 para. 5 in the event of a cancellation).
4.2 Short-term Cancellation (within 48 hours)
- For cancellations received less than 48 hours before the agreed appointment, the obligation to pay a cancellation fee in the amount of 50% of the agreed treatment price remains.
- This can be offset against any deposit paid.
4.3 Non-appearance without Cancellation
- If the customer does not appear for the agreed appointment without prior cancellation (no-show), 100% of the agreed treatment price becomes due.
- If no specific treatment was agreed upon in advance, 150.00 EUR per started hour will be charged.
4.4 Illness and Force Majeure
- If an agreed appointment cannot be kept due to illness or an accident, this must be proven by a medical certificate (in case of illness) or a police report (in case of an accident).
- In this case, the cancellation fee is waived entirely.
4.5 Customer's Burden of Proof
- The customer reserves the right to prove that Laser Angel suffered no damage or significantly lower damage.
§5 Delays
- Waiting times of up to 20 minutes are possible and will be compensated by Laser Angel as far as possible.
- In the event of a delay by the customer, they are obliged to inform Laser Angel immediately.
- In the event of a delay of more than 30 minutes, Laser Angel is entitled to assign the appointment elsewhere or – if a subsequent appointment exists and the treatment must be shortened – to charge the full treatment price.
§6 Right of Withdrawal
- If you are a consumer within the meaning of § 13 BGB (German Civil Code), you have a legal right of withdrawal.
- Cancellation Policy:
- You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
- The withdrawal period is fourteen days from the day the contract is concluded.
- To exercise your right of withdrawal, you must inform us (Laser Angel, Angila Nuristani, An der Alster 83, 20099 Hamburg) of your decision to withdraw from this contract by means of a clear statement (e.g., via email or letter).
- Please note: The right of withdrawal expires for service contracts if Laser Angel has fully provided the service and performance only began after the customer gave their express consent and simultaneously confirmed their knowledge that they lose their right of withdrawal upon full fulfillment of the contract.
§7 Customer Obligations / Contraindications
- The customer is obliged to provide complete and truthful information regarding their health status, any pre-existing conditions, medication intake, and intolerances prior to the treatment.
- Laser Angel is entitled to refuse or terminate a treatment if medical or safety-related contraindications exist.
- In this case, no cancellation fee will apply.
- Laser Angel assumes no liability for knowingly false information provided by the customer that leads to damage.
§8 Liability
- Laser Angel is only liable for damages within the framework of legal regulations, particularly in cases of intent and gross negligence.
- For slight negligence, Laser Angel is only liable for the breach of essential contractual obligations (cardinal obligations), and even then, only in the amount of the typically foreseeable damage.
- The limitations of liability do not apply to damages resulting from injury to life, body, or health.
§9 Data Protection
- The personal data collected during booking and treatment will be used exclusively for contract fulfillment and customer management.
- The data protection declaration of Laser Angel applies, which can be viewed on the website..
- No transfer to third parties takes place unless there is a legal obligation.
§10 Final Provisions
- The law of the Federal Republic of Germany applies.
- The place of performance and jurisdiction is Hamburg, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
- Should individual provisions of these GTC be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
- The invalid provision is to be replaced by a valid one that comes as close as possible to the economic purpose of the invalid one.
